Terms of Service

For the purposes of these Terms:

• "Service" refers to the Italian Brainrot Clicker game and ItalianBrainrot.tv website.
• "User" refers to the individual accessing or using the Service.
• "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to ItalianBrainrot Game Studio LLC.

• "Virtual Items" refers to virtual currency, points, or items that can be purchased or earned within the game.
• "Content" refers to text, images, videos, audio, or other material that can be accessed through the Service.
• "User-Generated Content" refers to material that users contribute to the Service.

Account Creation

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Age Restrictions

You must be at least 13 years old to create an account and use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agree to these Terms on your behalf.

We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Our Intellectual Property

The Service and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial use. This license does not include any resale or commercial use of the Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Service or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Content Ownership

When you create or upload User-Generated Content, you retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

Content Standards

User-Generated Content must comply with all applicable laws and regulations and must not:

• Contain any material that is defamatory, obscene, indecent, offensive, or hateful
• Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• Infringe any copyright, database right, or trademark of any person
• Be likely to deceive any person
• Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence
• Promote any illegal activity
• Be threatening, abusive, or invade another's privacy
• Be likely to harass, upset, embarrass, alarm, or annoy any other person
• Impersonate any person or misrepresent your identity or affiliation with any person

Content Monitoring

We do not actively monitor User-Generated Content, but we reserve the right to remove any content that violates these Terms or that we find objectionable. We also reserve the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you constitutes a violation of their intellectual property rights, or of their right to privacy.

In-Game Purchases

The Service may include the opportunity to purchase virtual, in-game items. You understand that these items are digital goods with no monetary value and do not constitute real-world currency or property. Your purchase of such items is final and non-refundable, except as otherwise required by applicable law.

Pricing and Payment

All pricing information is subject to change without notice. We make every effort to provide accurate pricing information, but we cannot guarantee the accuracy of such information. We reserve the right to correct any pricing errors or mistakes even if we have already requested or received payment.

Refunds

Refunds are only available in accordance with applicable laws, such as for defective products. Once you have made a purchase, we are unable to change our minds simply because you have changed yours.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or warranty, whether express, implied, or statutory. The Company specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Service will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations
• Any errors in the Service will be corrected

To the maximum extent permitted by applicable law, in no event shall the Company, its affiliates, directors, employees, agents, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, the Company assumes no liability or responsibility for:

• Any errors, mistakes, or inaccuracies of content
• Any personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Service
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the Service

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User-Generated Content
• Your use of the Service
• Your violation of any rights of another person or entity

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service, or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and/or via a notice on the Service.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to check these Terms periodically for changes. If you do not agree to any of the changes to these Terms, you must stop using the Service.
